YELC CRITERIA

Before accepting a request for assistance under either stream, YELC will need to be satisfied that an applicant is either:

  • A not for profit organisation which assists disadvantaged or marginalised groups, in-line with the objectives of YELC and ENYA.
  • A young person, between the ages of 15-25, who can demonstrate the need for legal assistance, who is unable to obtain Legal Aid and who cannot afford the services of a lawyer at the applicable professional charging rate.
  • A person in business who can demonstrate the need for legal assistance and could not, but for this service, afford to engage the services of a lawyer at the applicable professional charging rate.
  • Please note that no age limits apply to the Enterprise Stream.

YELC will also consider whether taking on a matter would duplicate the efforts of a more appropriate service. If YELC is unable to accept a client on this basis, we will make every effort to refer clients on.

In-line with the criteria mentioned above, YELC will take the following matters into consideration:

  • A client’s financial position.
  • The likelihood of success in litigious matters.
  • The availability of resources to effectively handle a matter.
  • The availability of a YELC solicitor with the appropriate level of expertise.
  • Whether a conflict of interest exists.
